What is the Class Action Fairness Act (CAFA)?
The Class Action Fairness Act of 2005 (CAFA) is a federal law that expanded federal court jurisdiction over large class action lawsuits. Among other requirements, CAFA mandates that defendants provide notice of proposed class action settlements to appropriate federal and state officials — typically the U.S. Attorney General and relevant state attorneys general — no later than 10 days after the settlement is filed with the court.
Why am I receiving CAFA notice?
As a state or federal official, you are receiving this notice because a class action settlement has been proposed that may affect residents or entities within your jurisdiction. CAFA requires that you be notified so that you may review the proposed settlement and, if appropriate, object or take other action before the court grants final approval.
What is the 90-day review period?
Under CAFA (28 U.S.C. § 1715), a court may not issue a final order approving a class action settlement earlier than 90 days after the defendant has served the required notice on the appropriate federal and state officials. This period gives regulators sufficient time to review the settlement terms and determine whether any action is warranted.

If you have concerns about any proposed settlement listed on this site, you should review all available documents and consult with legal counsel. As a state or federal official, you have the right to appear before the court and raise any objections during the 90-day review period. This site is specifically designed for state and federal regulatory officials who receive CAFA notices. If you are a class member seeking information about how to file a claim, opt out of a settlement, or object, you should refer to the Long Form Notice or Mailed Notice documents included in the case files, which contain complete instructions for class members.
